• I acknowledge, understand, and confirm that I am aware of the nature of the activities I will be participating in and that I am physically fit, in good health, and capable of participating. Furthermore, I agree that if at any point I feel the conditions are unsafe or experience any health concerns, I will immediately stop participating and, if necessary, remove myself from the activity.
• I authorize Houston Soccer Field, along with its owners, investors, members, managers, shareholders, agents, directors, officers, volunteers, employees, landowners, subsidiaries, and affiliated companies (collectively, the "Releasees"), as well as any medical care provider(s), to arrange emergency medical transport or administer medical care as deemed necessary at their sole discretion. I acknowledge that I am fully responsible for any costs incurred for such transport and care.
• I acknowledge that it is my responsibility to follow all posted and published procedures, including safety and hygiene protocols, designed to minimize the risk of disease transmission among participants and staff. I also understand that I must comply with all applicable laws and regulations imposed by federal, state, and local authorities.
• I understand that participation in the activities involves inherent risks and dangers, including but not limited to: falls, collisions, equipment-related injuries, actions or inactions of other participants or bystanders, equipment failure or misuse, and potential exposure to communicable diseases (including but not limited to COVID-19 and other pathogens). These risks can result in serious injury, illness, emotional distress, or death (collectively, "Risks").
• I recognize that the Risks may arise from my own actions, those of other participants or staff, the conditions of the premises, or the negligence of the Releasees. I further understand that not all risks can be fully outlined in this Agreement and that I may encounter both known and unknown risks.
• With full awareness of the above, I voluntarily assume all inherent and other risks of injury, illness, emotional distress, or death, and accept full responsibility for any losses, costs, or damages I may experience as a result of participating in the activities
• I hereby release, discharge, hold harmless, and agree never to sue the Releasees for any and all liability, claims, demands, losses, or damages arising out of or in connection with the activities, including injury, illness, emotional distress, or death, whether caused in whole or in part by the alleged or actual negligence of the Releasees. Furthermore, if I or anyone acting on my behalf files a claim against any of the Releasees despite this Agreement, I agree to defend, indemnify, and hold harmless the Releasees from any legal fees, losses, liabilities, damages, or expenses incurred as a result of such a claim.
• I acknowledge that this Agreement applies every time I am on the premises or participate in the activities. I understand that this Agreement is a binding contract, enforceable to the fullest extent allowed by law, and applies to me and my assignees, heirs, executors, and personal representatives. If any part of this Agreement is found to be unenforceable, the remaining provisions will continue to be in effect.
